Terms and Conditions (T&C)

Introduction

By submitting a booking request or making a booking, customers acknowledge the validity of these Terms and Conditions (T&C).

1. General / Scope of Application

Oh Darling Event und Marketing GmbH (hereinafter "Agency") arranges independent escort models for adult customers. The arrangement is made exclusively on behalf of and for the account of the respective models.

The agency itself does not offer erotic or sexual services and does not become a contractual partner of the services arranged through it. All agreements about the type, scope and duration of companionship are made exclusively between the model and the customer.

The agency acts exclusively as an intermediary. There is no employment relationship between the agency and the models, but an independent business relationship.

2. Booking Request and Conclusion of a Booking

The customer can submit a booking request by phone, e-mail, via the contact form or via Telegram. After consultation with the desired model and confirmation by the agency, the contract is considered concluded.

New customers are asked to contact the agency by phone before their first booking.

3. Role and Duties of the Agency

The agency undertakes to carry out the arrangement carefully and discreetly. The information, descriptions and photos of the models are based on their own information and templates.

No liability is assumed for their accuracy or currency. The agency is not liable for the type, content or quality of the service provided by the model.

Models act independently and are not vicarious agents of the agency.

4. Liability of the Agency

The agency is only liable in case of intent or gross negligence. For slight negligence, the agency is only liable in case of violation of essential contractual obligations (cardinal duties), the fulfillment of which first enables the proper execution of the contract.

Liability is limited to the contract-typical, foreseeable damage. The liability limitations do not apply to damages from injury to life, body or health as well as in case of fraudulently concealed defects.

To the extent that the agency's liability is excluded or limited, this also applies to its legal representatives, employees and vicarious agents.

5. Fees, Payments and Advance Payments

The models' fees are visible in their comp cards or on request. The agreed fee is usually handed over directly to the model in cash and in an unsealed envelope at the beginning of the booking.

Advance Payments

Advance payments or prepayments may be required in the following cases: for longer bookings (from 24 hours), for trips with overnight stays or flights, as well as for advance services such as hotel or ticket bookings.

Extensions

In case of an extension of the booking time, the additional fee must be handed over to the model immediately at the beginning of the extension.

All additional costs (e.g. travel, accommodation, meals, admission tickets etc.) are borne by the customer.

6. Cancellations

Advance payments already made will be charged accordingly. If a booking is cancelled more than 48 hours before the start, the advance payment remains valid for 8 weeks and can be credited to a new booking.

7. Concierge Service

Oh Darling Event und Marketing GmbH offers its customers additional concierge services on request. These include in particular the organization and booking of hotels, restaurants, transfers, events and other lifestyle and travel services.

Booking Types

Bookings can be made either in the customer's name or in the agency's name, depending on the customer's wishes.

Service Fees

• Service and organization flat rate: 15% to 25% of the booking value
• Simple bookings: 10% to 20% of the booking value, minimum €15
• Combination or special packages: flat rate from €25

Liability

The agency is only liable for the proper organizational processing of concierge services. The agency assumes no liability for service disruptions, defects or failures by third-party providers.

The discretion of customers has the highest priority. Personal data is used exclusively for the execution of the concierge service and treated strictly confidentially.

8. Data Protection, Discretion & Identity Verification

The agency processes personal data in accordance with applicable data protection regulations. Access to confidential content (e.g. unblurred photos, exclusive profiles or personal model information) requires age and identity verification.

Verification

Verification is generally carried out by presenting a valid photo ID. Customers who do not want to submit a direct identification copy can alternatively provide suitable screening information for legitimation.

For bookings over 48 hours or for international companionships, mandatory identity verification by presenting a photo ID is required.

The collected data is processed exclusively for the purpose of age and identity verification as well as billing.

9. Confidentiality, Image Rights & Contractual Penalties

Customers undertake to treat all information, photos and data of the models confidentially. Any storage, sharing, publication or creation of screenshots is prohibited.

Copyrights to texts, photos and content remain with the agency or the models.

10. Customer Behavior

Customers undertake to treat the models with respect, care and safety. Models must not be endangered, harassed or violated in their dignity.

Customers are liable for damages they cause to models in the context of the booking.

11. Legal Obligations / Condom Requirement

Customers are obliged to comply with this regulation. A violation constitutes an administrative offense and can be punished with a fine.

Models are entitled to terminate a booking immediately if the customer violates legal regulations or agreed boundaries.

12. Final Provisions

Should individual provisions of these T&C be invalid, the validity of the remaining provisions remains unaffected. Instead of the invalid provision, insofar as legally permissible, a regulation that comes closest to the economic purpose of the invalid provision applies.
